general sales and shipping conditions >PREAMBLE >DEFINITIONS Within the framework of the presents, the following words or expressions shall be construed as indicated below: Internet Boutique: designates the France To Home internet site on which the Products are presented and sold to customers.
>ARTICLE 1 - PURPOSE The purpose of the present General Sales Conditions is to establish the terms and conditions under which France To Home shall offer and sell its Products to its customers. >ARTICLE 2 - ACCEPTANCE OF CONDITIONS The customer recognizes having been aware, at the time of placing their Order, of the present General Sales Conditions and expressly declares to accept them unconditionally. >ARTICLE 3 - PRODUCTS The photographs illustrating the Products shall be non-binding. France To Home shall not be responsible for any errors that may occur. The majority of products offered by France To Home to its customers are immediately available. However, the products marketed by France To Home may or may not necessarily be available for purchase online. >ARTICLE 4 - ORDERING The automatic registration systems shall constitute proof of the nature, content and date of the Order. France To Home shall confirm acceptance of its Order to the customer by sending a confirmation message to the e-mail address that this latter will have communicated. The sale shall not be closed until confirmation of the said order has been sent. France To Home shall reserve the right to refuse or cancel any Order from a customer, in particular in the case of insolvency of the said customer or in the case of default in payment of the Order concerned, of a prior delivery or any litigation pertaining to payment of a previous order. Information provided by the customer upon entry of their Order shall be binding. France To Home shall not be held responsible for any errors made by the customer with regards to contact details of the addressee of the Order (delivery and billing addresses in particular) and delivery delays or the impossibility of delivering the Products ordered that may result from the said errors. >ARTICLE 5 - DELIVERY Upon confirmation of the Order and subject to full payment of the price of products ordered, France To Home pledges to ship to its customer, at its own risk, the products ordered to the delivery address as soon as possible. All Products specified in Orders placed with France To Home are intended for the personal use of its customers or addressees whose name figures on the delivery address. The customer pledges to pay upon delivery, any present or future taxes, duties, or other surcharges resulting from the delivery of the products themselves as the need arises. France To Home shall at no time be responsible for settling the said taxes, duties, or surcharges. The customers or the addressees of the Products pledge that they shall not sell any Products. Delivery shall be made by the postal services designated by France To Home. The delivery charges applied to each order are available upon simple request addressed to France To Home by completing the contact form found on the www.france-beautycare.com site, including the n° of the bill of the order in question. France To Home shall not be liable for damages resulting from any delays in delivery, whether attributable to the carrier or France To Home. The Products ordered are shipped at the customer's risks. Upon reception of the Products ordered, the customer or the addressee shall verify the good condition of the goods delivered and shall observe the instructions that figure on the leaflet provided. Should one or several of the Products ordered be missing or damaged, the customer or the addressee must make any claims with the carrier at the moment of delivery. Should any defects be apparent, the customer shall have the right to return the merchandise under the precise conditions provided for in article 6 - WITHDRAWAL. The following events and circumstances shall be considered as cases of force majeure relieving France To Home of its obligation to deliver: war, riots, fires, strikes, accidents and the impossibility of procuring supplies. According to the availability of Products ordered, an Order may require several successive deliveries in order to be filled. Should the customer wish to have their order delivered to two separate addresses, it is in their best interest to place 2 separate Orders. >ARTICLE 6 – WITHDRAWAL Should the customer wish to exchange Products or be reimbursed for them, they must return them to France To Home within 7 days from the date of reception. The Products must be returned new in the original packaging, intact, including any accessories, instruction leaflets and documentation to the following address:
Reimbursement shall be due no later than 15 days thereafter. >ARTICLE 7 - PRICE The price is expressed in euros and in US dollars. The price indicated on the Product Sheets includes the expenses arising from packaging and shipping. The price indicated on the Order confirmation is final and is inclusive of all taxes and VAT. It additionally includes all charges relating to handling and Product conservation. >ARTICLE 8 – PAYMENT The price invoiced to the customer is the price indicated on the Order confirmation addressed by France To Home. The price of the Products is payable in cash using one of the payment methods available on the site on the effective day of the order. The customer-validated Order shall be considered effective once the secured bank payment centre has approved the transaction. Should the transaction be refused by secured bank payment centre, the Order shall be automatically cancelled and the customer notified by e-mail. The secured bank payment centre and the France To Home outlet through which you make your purchase are the addressees provided in relation to your order. The non-transmission of data in relation to your order blocks the transaction and any analysis thereof. >ARTICLE 9 - APPLICABLE LAW The present General Sales Conditions shall be subject to French law. >ARTICLE 10 – RESPONSIBILITY France To Home shall not be responsible for damage of any kind, whether material, immaterial or bodily harm, that may result from poor functioning or improper utilisation of the Products that it markets, nor for any Product modifications resulting from manufacturers' intervention. The responsibility of France To Home shall be limited in any event to the amount of the order and shall not be engaged for simple errors or omissions that may result despite all its best efforts made in the presentation of its products. The customer and France To Home hereby agree that they will make every effort to resolve any difficulties encountered in the application of the provisions of the present contract out of court. Otherwise, the Tribune of Commerce of Nice, France shall have sole jurisdiction over any litigation between the parties, regardless of the delivery location or method of payment accepted. >ARTICLE 11 – GUARANTEE In any event, France To Home shall not be held responsible for the non-respect of regulatory and legislative provisions in force in the country of reception. The responsibility de France To Home is expressly limited to the value of the Product in question determined at the date of sale and the customer shall hold both the brand and the manufacturing company of the product harmless from any damage exceeding the said amount. In any event, the customer shall benefit from the legal guarantee against eviction and hidden defects provided for in articles 1625 and following of the Civil Code. The customer may contact customer service by mail at contact@france-beautycare.com Response within 48 hours. >ARTICLES 12 - LEGAL INFORMATION The gathering of nominative information for the purposes of sales by correspondence is obligatory. This information is essential to processing and carriage of orders, drawing up invoices and warranty contracts. The lack of this information may invalidate the Order. In compliance with the "Freedom of Information Act," nominative information processed relative to customers has been submitted via a declaration made before the National Commission for Freedom of Information (CNIL). In virtue of article 34 of the Law of 6 January 1978, customers have the right to access, modify, rectify and delete data concerning them and may exercise this right with France To Home. Further, France To Home pledges not to transmit, whether free of charge or against consideration, the contact details of its customers to any third parties. |
